Welcome to Atlantis ("Atlantis," "we," "us," or "our"), a service of DevDash Labs. These Terms of Service ("Terms") govern your access to and use of our website atlantis.devdashlabs.com (the "Site") and our AI-powered deep research services (collectively, the "Services").
Please read these Terms carefully before using our Services. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
We reserve the right to modify these Terms at any time. We will indicate any changes by updating the "Last Updated" date of these Terms. You are encouraged to periodically review these Terms to stay informed of updates. Your continued use of the Services after the date such revised Terms are posted will constitute your acceptance of the changes.
1. ACCEPTANCE OF TERMS By creating an account, accessing the Site, or using the Services, you affirm that you are at least 18 years of age and are otherwise fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.
2. DESCRIPTION OF SERVICE Atlantis provides an AI-powered deep research agent designed to deliver comprehensive research reports on a wide range of topics. The Services leverage artificial intelligence and may access publicly available internet sources to generate information.
3. ELIGIBILITY AND USER ACCOUNTS You must be at least 18 years old to use the Services. By registering for an account and using the Services, you represent and warrant that you are 18 years of age or older (confirmed via a self-attestation checkbox during registration) and agree to abide by all of the terms and conditions of these Terms. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. USER CONDUCT AND ACCEPTABLE USE
You agree not to use the Services for any purpose that is illegal or prohibited by these Terms. You agree to comply with all applicable local, state, national, and international laws and regulations.
a. Prohibited Activities: You shall not: * Use the Services in any manner that could damage, disable, overburden, or impair the Services. * Attempt to gain unauthorized access to the Services, other accounts, computer systems, or networks connected to the Services. * Use any automated means, including robots, crawlers, or data mining tools, to download, monitor, or use data or content from the Services, except as explicitly permitted by us (e.g., for accessibility purposes or by search engines). * Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature. * Use the Services to generate, promote, or distribute any content that is illegal, harmful, abusive, harassing, defamatory, obscene, hateful, or otherwise objectionable. * Infringe upon the intellectual property rights of others.
b. Fair Use and Beta Limitations: * Your use of the Services is subject to fair use. We reserve the right to impose limits on your use of the Services to ensure equitable access for all users and to prevent abuse. * For the beta launch of Atlantis, use of the deep research feature is limited to ten (10) queries per user per day. This limit is subject to change at our sole discretion. Additional limitations or fees may apply for future versions or subscription tiers of the Service.
5. INTELLECTUAL PROPERTY RIGHTS
a. User-Generated Content: * You retain ownership of the intellectual property rights in the specific research queries you submit and the final research reports generated by the Services specifically for you based on your queries ("User Reports"). * By using the Services, you grant DevDash Labs a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the queries you submit solely for the purpose of operating, providing, and improving the Services.
b. Atlantis Service and Content: * The Services and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all Intellectual Property Rights related thereto (excluding User Reports), are the exclusive property of DevDash Labs and its licensors. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights.
6. FEES AND PAYMENT (Beta Service) During the current beta phase, access to Atlantis and its research features is provided free of charge, subject to the usage limitations specified in Section 4(b). We reserve the right to introduce subscription fees, change usage limits, or modify access terms for future versions of the Service. Any such changes will be communicated by updating these Terms or through other means on the Service.
7. DISCLAIMERS
a. Accuracy of AI-Generated Content: THE SERVICES, INCLUDING ALL AI-GENERATED REPORTS AND INFORMATION, ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY. ATLANTIS USES LARGE LANGUAGE MODELS AND AUTOMATED PROCESSES TO GATHER AND SYNTHESIZE INFORMATION. WHILE WE STRIVE FOR ACCURACY, WE MAKE NO WARRANTIES OR REPRESENTATIONS REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, SUITABILITY, OR VALIDITY OF ANY INFORMATION OR REPORTS GENERATED BY THE SERVICES. AI-GENERATED CONTENT MAY CONTAIN INACCURACIES, ERRORS, OR OMISSIONS, AND MAY BE BASED ON INCOMPLETE OR OUTDATED INFORMATION. YOU ACKNOWLEDGE AND AGREE THAT ANY RELIANCE ON INFORMATION OR REPORTS PROVIDED BY THE SERVICES IS AT YOUR SOLE RISK. YOU ARE SOLELY RESPONSIBLE FOR EVALUATING THE ACCURACY AND APPROPRIATENESS OF THE INFORMATION FOR YOUR NEEDS AND SHOULD INDEPENDENTLY VERIFY ANY INFORMATION BEFORE MAKING DECISIONS BASED ON IT. ALWAYS DOUBLE-CHECK THE FINAL RESULTS.
b. "As Is" and "As Available": THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEVDASH LABS AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
8. LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEVDASH LABS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICES. UNDER NO CIRCUMSTANCES WILL DEVDASH LABS BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICES OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNTS PAID BY YOU TO DEVDASH LABS FOR ACCESS TO OR USE OF THE SERVICES DURING THE THREE (3) MONTH PERIOD PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY (IF ANY).
9. INDEMNIFICATION You agree to defend, indemnify, and hold harmless DevDash Labs, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Services.
10. TERM AND TERMINATION These Terms shall remain in full force and effect while you use the Services. We may suspend or terminate your access to the Services at any time, for any reason or no reason, including for any breach of these Terms, in our sole discretion, without prior notice or liability. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. CHANGES TO TERMS OF SERVICE We reserve the right, in our sole discretion, to modify or replace these Terms at any time. We will indicate any changes by updating the "Last Updated" date of these Terms. You are responsible for regularly reviewing these Terms. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
12. GOVERNING LAW These Terms shall be governed and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
13. DISPUTE RESOLUTION
a. Informal Resolution:
We want to address your concerns without needing a formal legal case. Before filing a claim against DevDash Labs, you agree to try to resolve the dispute informally by contacting support@devdashlabs.com. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within thirty (30) days of submission, you or DevDash Labs may bring a formal proceeding.
b. Binding Arbitration: You and DevDash Labs agree to resolve any claims relating to these Terms or the Services through final and binding arbitration, except as set forth under Exceptions to Agreement to Arbitrate below. The arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and, where applicable, the Supplementary Procedures for Consumer Related Disputes, then in effect (the "AAA Rules"). The arbitration will be held in the State of New Jersey, USA, or any other location we mutually agree to. The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by contacting DevDash Labs.
c. Class Action Waiver: YOU AND DEVDASH LABS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and DevDash Labs agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
d. Exceptions to Agreement to Arbitrate: Notwithstanding the foregoing, either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Services, or intellectual property infringement (for example, trademark, trade secret, copyright, or patent rights) without first engaging in arbitration or the informal dispute-resolution process described above.
14. MISCELLANEOUS
a. Entire Agreement: These Terms constitute the entire agreement between you and DevDash Labs concerning the Services and supersede all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and DevDash Labs. b. Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable. c. Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and DevDash Labs's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
